 The Baron Mardon Inc. (hereinbelow referred as “Baron”) is committed to protecting and respecting your privacy.  

This Privacy Notice describes the types of personal information we collect about applicants, how we may use the information and with whom we may share it. The notice also describes the measures we take to safeguard the personal information. In addition, we tell you how you can ask us to (i) access or change the personal information we maintain about you, (ii) withdraw consent you previously provided to us, (iii) refrain from sending you certain communications, and (iv) answer questions you may have about our privacy practices.  Submitting the electronic pre-qualification “apply now” form confirms your interest in pursuing employment opportunities with Baron. After we receive your “apply now” form, a representative will contact you regarding next steps.  

This Privacy Notice is not a contract and does not create any contractual rights or obligations.  

1. DEFINITIONS  

·        Personal Data – any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;  

·        Processing – any operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;  

·        Consent – any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of Personal Data relating to him or her;  

·        Data subject – a natural person whose Personal Data is being processed;  

2. HOW WE COLLECT PERSONAL DATA? 

  We receive your Personal Data directly from you. Examples of situations where Baron collects Personal Data directly are as follows:  
·        By filling out any part of the application form on our website or any webpage on our website;  
·        By opening and responding to our e-mails;  
·        By visiting any page online that displays our ads or content;  
·        By directly calling Baron or its affiliates on the phone numbers provided on the website;  
·        By providing information to Baron’s employees through email, phone or facsimile;  
·        By interacting with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.  Sometimes we collect information through cookies or other web technologies. For example, we may record information:  
·        When you access our website;  
·        When you browse webpages on our website;  
·        When you search for information on our website;  
·        When you click to or view on our sites or on third-party sites our ads; 
·        When you open our e-mails or click on any of its links.  If we use your personal information for other purposes than those above mentioned, we will notify you of these purposes before using your information and obtain your consent where necessary. 

3. WHAT DATA WE GATHER?  

The types of Personal Data we may obtain directly from you include:  
·        Full name;  
·        State/Province where you are located; 
·        Email address;  
·        Phone number;  Through cookies or other web technologies we may record information:  
·        About your operating system, browser version, IP address, and mobile device;  
·        On our sites about the web pages that you view;  
·        Information you search for;  
·        Which ads or web content from us you click to or view on our sites or on third-party sites;  
·        When you open our e-mails or click on any of its links. 

  4. ON WHAT LEGAL GROUNDS WE PROCESS YOUR PERSONAL DATA?  

Personal Data shall only be collected, used, stored or otherwise processed when necessary within the framework of responsible, efficient and effective business management. In general, Baron processes your Personal Data based on one of the following legal grounds:  

·        The processing is necessary to perform an agreement between you and Baron;
·        The processing is necessary for us to comply with our legal obligations; 
·        The processing is necessary to protect your vital interests or those of other individuals;  
·        The processing is necessary for the legitimate interests of Baron, except where such interests are overridden by your interests or fundamental rights and freedoms, or  
·        Where appropriate and required, we will ask for your consent.  

5. HOW WE USE YOUR PERSONAL DATA?  

Baron shall only collect, use or otherwise process Personal Data if the processing falls within the scope of one (or more) of the legitimate business purposes listed below:  
·        Process employment applications for open job positions;  
·        Answer questions and respond to your requests;  
·        Make our sites easier to use;  
·        To carry out our obligations and enforce our rights arising from any contracts entered into between you and us;  
·        To comply with applicable laws and regulations;  
·        To advertise and market our vacant positions in social media platforms and other websites;  
·        Analyze the effectiveness of ads;  
·        Determine whether you would be interested in new job positions;  
·        To conduct research and analysis;  

6. WHO ELSE CAN ACCESS YOUR DATA?  

Baron may share your personal data with its affiliates, operating groups, subsidiaries and divisions, or with third parties if such is necessary for the purposes as listed above. If appropriate, Baron will require third parties to conduct activities in a manner consistent with Baron’s policies and guidelines in relation to data protection.  

We may also disclose your personal information with data processors, i.e., parties such as vendors or service providers processing Personal Data on our behalf. In such cases, these third parties only use your Personal Data for the purposes described above and only in accordance with our instructions. 

Baron will only use processors which provide sufficient guarantees to implement appropriate technical and organizational measures and ensure the protection of the rights of Data Subjects.  
Baron may also share your personal data with its employees if and to the extent necessary for the performance of their tasks. In such a case, access will be granted only if and to the extent necessary for the purposes described above and only if the employee is bound by confidentiality.  
Baron may share your personal information with law enforcement agencies or other governmental agencies if and when required to do so by law, court order, or other legal process in order to establish or exercise our legal rights.  

7. HOW WE SECURE YOUR DATA?  

We do our best to keep your Personal Data safe. We use reasonable administrative, technical, and physical security measures to protect your personal information. These measures include computer safeguards and secured files. Please do not send us any personal information through unsecured channels.  

Even though we try our best we cannot guarantee the security of information. However, the safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.  

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our website or to Baron through other means of communication. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on any of our applications, including our website. We promise to notify suitable authorities of data breaches. We will also notify you if there is a threat to your rights or interests.  

8. HOW WE STORE YOUR DATA AND WHERE WE TRANSFER IT?  

In the event Baron needs to transfer your Personal Data to locations outside the country where you reside, we shall ensure that such a transfer is subject to appropriate safeguards. For the European Economic Area, such transfers to third parties (outside the European Economic Area) will be governed by a contract based on the model contractual clauses for data transfers approved by the European Commission or other appropriate safeguards. By submitting your Personal Data, you agree to the data transfer, storing or processing.   
We hold your information only as long as necessary for the purposes set out above or, if you request not to be contacted by us, we will keep some basic information in order to avoid sending you unwanted communications in future.  

9. WHAT RIGHTS DO YOU HAVE IN RELATION TO YOUR PERSONAL DATA?  

Based on the law applicable to the use of your Personal Data, you may have rights that you can exercise in relation to your Personal Data. Note that in some cases we are not required to completely comply with your request, as such rights may be conditional or because we have to balance your rights against our rights and obligations to process your Personal Data and to protect the rights and freedoms of others. A number of the rights you have in relation to your Personal Data, as applicable in the European Economic Area, the State of California, or other US or international geographic jurisdictions, are explained below:  

·        Right of access – You may be entitled to a copy of the Personal Data we hold about you and to learn details about how we use it. Your Personal Data will usually be provided to you digitally. We may require you to prove your identity before providing the requested information.  

·        Right to rectification – We take reasonable steps to ensure that the information we hold about you is accurate and complete. However, if you believe this is not the case, you may have the right to request that any incomplete or inaccurate Personal Data that we process about you is amended.  

·        Right to erasure – You may have the right to ask us to erase your Personal Data, for example where the Personal Data we collected is no longer necessary for the original purpose, where Personal Data has become obsolete or where you withdraw your consent (if we are processing your Personal Data based on consent). However, this will need to be balanced against other factors. For example, we may not be able comply with your request due to certain legal or regulatory obligations.  

·        Right to restriction of processing – You may be entitled to ask us to (temporarily) stop using your Personal Data, for example where you think that the Personal Data we hold about you may be inaccurate or where you think that we no longer need to use your Personal Data.   

·        Right to data portability – You may have the right to ask that we transfer Personal Data that you have provided to us to a third party of your choice. This right can only be exercised when you have provided the Personal Data to us, and when we are processing that data by automated means on the basis of your consent or in order to perform our obligations under a contract with you.   

·        Right to object – You may have the right to object to processing which is based on our legitimate interests. In case of the processing of Personal Data for marketing purposes, you have the right to object at any time. When you ask us to stop using your Personal Data for marketing purposes, Baron will immediately cease to use your Personal Data. For other purposes based on our legitimate interests, we will no longer process the Personal Data on that basis when you file an objection based on your grounds relating to your particular situation, unless we have a compelling legitimate ground for the processing. Note, however, that we may not be able to provide certain services or information if we are unable to process the necessary Personal Data for that purpose.  

·        Rights relating to automated decision-making – You may have the right not to be subjected to automated decision-making, including profiling, which produces legal effect for you or has a similar significant effect. If you believe you have been subject to an automated decision and do not agree with the outcome, you can contact us using the details below and ask us to review the decision.  

·        Right to withdraw consent – We may ask for your consent to process your Personal Data in specific cases. When we do this, you have the right to withdraw your consent at any time. Baron will stop the further processing as soon as possible after the withdrawal of your consent. However, this does not affect the lawfulness of the processing before consent was withdrawn.  

10. CALIFORNIA CONSUMERS  

If you reside in California, we are required to provide additional information to you about how we use and disclose your information, and you may have additional rights with regard to how we use your information. We have included this California-specific information below.  

Consistent with the Section 3: “What Data We Gather?” above, we collect certain categories and specific pieces of information about individuals that are considered “Personal Information” in California. As detailed above, we may collect this Personal Information from you and other third parties. We collect, share and disclose Personal Information for the business and commercial purposes described in the Section 5 “How We Use Your Personal Data?” above.   

We do not “sell” your Personal Information, as this term is defined under California law. Given the divergent practices of organizations that offer browsers and the lack of a standard in the marketplace, we do not respond to Do Not Track signals at this time.  

Subject to certain exceptions, as a California consumer, you have the right to: (i) access your Personal Information and (ii) obtain deletion of your Personal Information. To the extent permitted by applicable law, we may be required to retain some of your Personal Information, and certain Personal Information is strictly necessary in order for us to fulfill the purposes described in this Privacy Policy.  

Should you wish to request the exercise of your other rights as detailed above in Section 9 “What Rights Do You Have in Relation to Your Personal Data?”, we will not discriminate against you by offering you different job positions, offers or services, or by providing you with a different level or quality of services, based solely upon this request. Please contact us as described above to exercise such rights.  

If you are a California consumer and you wish to exercise your rights as outlined in this section, you may need to provide information such as name and e-mail so that we can verify your identity. We will use the information you provide when exercising your rights for no other purpose other than to verify your identity.  

You also have the option of designating an authorized agent to exercise your rights on your behalf.  For authorized agents submitting requests on behalf of California residents, please contact us as described below in Section 16 “Contact Us”, with any evidence you have that you have been authorized by a California consumer to submit a request on their behalf.  

11. USE OF COOKIES, IP ADDRESSES, WEB BEACON AND GOOGLE ANALYTICS  

Cookies are small text files that a website might place on your hard drive whenever you visit the website. Their purpose is to identify files on your computer and record your preferences and other data about your visit to our website so that when you return to the website, we are aware of who you are and can help personalize your next visit here. Please note that cookies may be linked to personal information about you. The use of cookies allows us to keep track of activity on our webpages and may (if you do not disable or refuse the use of a cookie) prevent you from having to reenter your information at each connection.  

There may be a time that we use the information collected by the cookies as well as other tools such as log files or web beacons for additional purposes such as to determine how Baron, may improve our website by seeing which features, areas and products are most popular. This would enable us to personalize the website experience and allow making recommendations to you based upon your link history. Please note that most internet browsers are automatically preset to accept all cookies. In the event you choose to disable this function some areas of our website may not function properly.  

In addition to cookies and log files we do at times use a common internet technology called “web beacons”. These are small graphic images placed on a web page, web-based document, or an email address that is designed specifically to allow us or our third-party vendors to collect certain information and monitor use activity on our website. Please note these are invisible to the user because they are typically very small. In furtherance of our privacy policy please note we do not use web beacons to collect the personal information about you. We may use them to collect non-personal information such as the URL of the page where the web user comes from and the time the web beacon is activated.

Facebook and other third parties may use Cookies, web beacons, and other storage technologies to collect or receive information from Baron and elsewhere on the internet and use that information to provide measurement services and targeted ads to website users. You may also view your Facebook ads settings to update your preferences at any time.   

12. OPT-OUT  Baron may contact you to offer you vacant job positions and services that may be of interest to you. To opt-out of receiving emails, telephone solicitations or other forms of contact from Baron, and our trusted business partners regarding open positions and other offers, please press the unsubscribe button or send an email to  info@Baronmardon.com.  

You must include your full name and email address. Once we locate your contact information based on the information you provide us, it will be removed from our databases and mailings lists.  

13. CHILDREN UNDER 13  Our sites are not for children under 13 years old. We do not knowingly solicit data online from, or market online to, children under 13. If we knowingly receive a child’s personal information, we will delete it from our systems.  

14. UPDATES OF THIS PRIVACY POLICY  We may change this privacy policy at any time. Changes are effective when we post them on this site and we encourage you to visit this site frequently for updates, as these updates will only be made available through this site unless otherwise and specifically requested from you.   The date the privacy policy was last revised is identified at the top of the page.  

15. INVALIDITY  If any provisions of this Privacy Policy are held to be illegal, invalid or unenforceable, then such provisions shall be severed and deleted without affecting the enforceability of the remaining provisions.
